JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-06-2018 Petitioner apprehends her arrest in connection with Lauriya P.S.Case No. 265 of 2017 registered for the offences punishable under Sections 406, 409, 420, 467, 468 and 471/34 of the Indian Penal Code.

Allegation against the petitioner is of misappropriation of Government money and financial irregularity with respect to distribution of cycle among the students.

Submission of learned counsel for the petitioner is that no specific allegation is attributed against the petitioner and she has also made complaint against the clerk of the school as he was not producing the paper and, as such whatever allegation is made that is against the clerk and not against the petitioner and petitioner is ready to abide by any condition if she is granted privilege of

Having heard both sides and in the facts and circumstances, let the petitioner, above named, surrender within a period of six weeks from the receipt of this order and on her so surrendering she shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, West Champaran, Bettiah, in connection with Lauriya P.S.Case No. 265 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned and further condition is that she has to co-operate in investigation of the case and appear before the police as and when required, otherwise prosecution will be at liberty to move cancellation of her bail bond.
