Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Bihpur P.S. Case No. 183 of 2022 lodged under Sections 302, 34, 201, 120 (B) of the I.P.C.

As per the prosecution case, the allegation has been made by the informant that he received information that her sister was subject to torture at the hand of her in-laws. Informant has disclosed that 6 named accused persons (entire family members of the deceased) in connivance with each other, killed his sister by strangulating her neck with the help of saree. With this allegation this F.I.R. has been lodged.

Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He further

Learned counsel for the petitioner submits that petitioner is the father-in-law and he is aged about 74 years. He submits that the allegations made against the entire family members are general and omnibus. Learned counsel for the petitioner submits that the husband of the deceased is already in judicial custody. He submits that the mother-in-law of the deceased has already been granted bail by the Co-ordinate Bench of this Court vide order dated 20.10.2022 in Cr. Misc. 45575 of 2022, where the Court has acknowledged from the post-mortem report that there is no external injury found at the body of the deceased and cause of her death is Asphyxia due to hanging.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. II, Naugachia, DistrictBhagalpur in connection with Bihpur P.S. Case No. 183 of 2022, subject to the conditions as laid down under Section 437(3) of

Patna High Court CR. MISC. No.65317 of 2022(2) dt.22-12-2022 3/3 Cr.P.C.

With this observation, the bail application stands allowed.
