The petitioner is in custody since 13.07.2019 in connection with Nabinagar P.S. Case NO. 201 of 2019 for the offence registered under Sections 30 (a) of the Bihar Prohibition and Excise Act, 2018.

Learned counsel for the petitioner submits that the alleged recoveries were not made from the conscious possession of the petitioner but from an under construction house which was in the custody of one Sanjay Singh.

Considering the aforesaid facts and circumstances of the case and that the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the
