2. The accused/petitioner seeks bail in connection with Ramkrishna Nagar P.S. Case No.313 of 2025 registered for the offences punishable under Sections 103 read with 3(5) of the Bhartiya Nyaya Sanhita, 2023 (for short 'B.N.S.') and Section 27 of the Arms Act.
3. The accused/petitioner is named in the FIR and is in custody since 24.04.2025.
4. As per FIR, the driver of the bus bearing Registration No. BR-06PE-9721 was killed by petitioner and other co-accused persons due to rivalry developed out of bus operation on the road.

Mr. Ajay Kumar Thakur, learned counsel while arguing for petitioner submitted that from the facial perusal of FIR, it can be gathered safely that the entire allegation against petitioner raised on the basis of suspicion. It is pointed out that during the course of investigation, no incriminating material was recovered/surfaced, which may suggest the involvement of petitioner with crime in question. It is pointed out by Mr. Thakur that one similarly situated co-accused namely, Bipin Singh @ Bipin Kumar Shukla @ Bipin Kumar has already granted bail by one of the learned co-ordinate Bench of this Court through Cr. Misc. No.64504 of 2025 dated 18.09.2025. While concluding argument, it is submitted that investigation of this case is already completed, for which, charge-sheet has been submitted and, as such, there is no chance of tampering with the evidence and moreover the petitioner claimed antecedent.
6. Learned APP while opposing the prayer of bail could not disputed the aforesaid factual submissions.
7. In view of aforesaid factual submissions and by taking note of fact as prima facie save and except suspicion as raised thrugh FIR, nothing incriminating appears during investigation against petitioner as to connect him with present

No.64859 of 2025(4) dt.30-10-2025 3/3 crime in question, coupled with the fact that investigation of this case is already completed, where petitioner remains in custody since 24.04.2025, accordingly, the petitioner, above-named, is directed to be released on bail furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Patna in connection with Ramkrishna Nagar P.S. Case No.313 of 2025, subject to the conditions as laid down under Section 437(3) of the Code of Criminal Procedure (for short 'CrPC')/under Section 480(3) of the Bhartiya Nagrik Suraksha Sanhita (for short 'BNSS') and with further conditions:- (i) That petitioner shall appear in the trial regularly either personally or through his lawyer and shall co-operate in the trial. Any non-cooperation in the trial shall result into cancellation of bail bonds of the petitioner, if any such prayer qua cancellation be raised by State.
