1. Heard learned counsel for the petitioner and learned counsel for the State.

2. The petitioner apprehends his arrest in connection with G.R. No. 1086 of 2023 arising out of Bisfi (Patauna) P.S. Case No. 259 of 2023 registered under Sections 272, 273 of the Indian Penal Code and Section 30(a) of Bihar Excise Act.

3. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further submission is that nothing has been recovered from the conscious possession of the petitioner rather the illicit liquor has been recovered from under the bridge. The petitioner has got no criminal antecedent.

4. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the

Patna High Court CR. MISC. No.68292 of 2023(2) dt.01-11-2023 2/2 event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of Additional Sessions Judge-II-cumSpecial Judge Excise Act, Madhubani in connection with G.R. No. 1086 of 2023 arising out of Bisfi (Patauna) P.S. Case No. 259 of 2023, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
