The petitioner, who is brother-in-law of the deceased, seeks anticipatory bail in connection with Sugauli P. S. Case No. 33 of 2018, registered for offences punishable under Sections 304 (B)/34 of the Indian Penal Code.
Allegation against the petitioner is of killing the deceased due to non fulfillment of dowry demand and lastly she was burnt badly by her husband and other in-laws. Submission of the learned counsel for the petitioner is that the petitioner and husband of the deceased were living separately since long and he was not present on the date of occurrence. Having heard both sides and in view of the facts and circumstances discussed above, let the petitioner, above named, surrender before the Court below within a period of four weeks from receipt of order and he will be released on bail on furnishing bail bond of Rs. 25,000/- ( twenty five thousand ) with two sureties of the like amount each in connection with Sugauli P.S.Case No. 33 of 2018 to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran, subject to the conditions laid down under Section 438 ( 2) Cr.P.C. with other conditions that bailors should be local having sufficient immovable property within the jurisdiction of the Court concerned and petitioner shall cooperate in the investigation and shall be present before police as and when required, otherwise prosecution is at liberty to move for cancellation of his bail bonds.
