2. Heard learned counsel for the petitioners and learned APP for the State.
3. The petitioners are apprehending their arrest in connection with Turkauliya P.S. Case No. 496 of 2023 instituted for the offences under Sections 147, 447, 341, 323, 379, 427, 504, 506 and 307 of the Indian Penal Code.
4. As per prosecution case, the allegation against the
Patna High Court CR. MISC. No.69294 of 2024(2) dt.23-10-2024 2/3 petitioners along with others is of assaulting the informant and his son, due to which they sustained injuries. It is further alleged that the accused persons damaged his clinic and CCTV Camera and snatched some articles.
5. Learned counsel appearing on behalf of the petitioners has submitted that petitioners are innocent and have committed no offence. There is no specific allegation against these petitioners rather general and omnibus allegation levelled against him. He submitted that the informant and his son sustained simple injuries. He further submitted that both the parties have entered into compromise and in support of this annexure-3 is annexed with this petition. It is next submitted that the petitioners having no criminal antecedent.
6. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioners.
7. Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., East Champaran, Motihari in connection with Turkauliya P.S.
