2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 414, 420, 467, 468 , 471 and 120 B of IPC and 30 (a) of Bihar Prohibition and Excise (Amendment ) Act.
3 . It is alleged that 7050 liters of spirit was recovered from the seized vehicle .
4. It is submitted that the petitioner is innocent and has falsely been implicated in this case only on the basis of suspicion . Petitioner is neither owner nor driver of he seized vehicle . No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery . Petitioner claims clean

5 . Learned counsel for the State opposes the bail petition .
6. Considering the fact that aforesaid facts and other circumstances of the case , in the event of arrest/surrender within eight weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise Court No. 1 East Champaran Motihari in connection with Paharpur Police Station Case No. 452 of 2022 , subject to the conditions laid down under section 482 ( 2 ) of the Bharatiya Nagarik Suraksha Sanhita ( BNSS) , 2023 .
