Petitioners apprehend their arrest in connection with Tarabari P.S.Case No. 45 of 2017 registered for the offences punishable under Sections 302 and 120B of the Indian Penal Code. Petitioner No.1 is brother-in-law of the deceased, petitioner No.2 is sister of the deceased and petitioner No.3 is nephew of the deceased and allegation them is of causing her death by hanging her outside the house.

Submission of learned counsel for the petitioners is that there is no specific allegation against the petitioners and they have been made accused only because they are family members and dead was found hanging on a tree outside house.

Having heard both sides and in the facts and circumstances, let the petitioners, named above, in the event of their arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the SubDivisional Judicial Magistrate, Araria, in connection with Tarabari P.S.Case No. 45 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
