JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-06-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Mali P.S. Case No. 02 of 2014 registered for the offences punishable under Sections 341, 323, 325, 427, 452, 379, 435 of the Indian Penal Code and Section 17 of C.L.A. Act. Petitioner and other F.I.R. named accused as well as some unknown persons not only assaulted the informant but also put the bundles of paddy on fire.

Submission on behalf of the petitioner is that the petitioner being agnate of informant has been implicated in this case on account of previous enmity and land dispute. It appears that anticipatory bail of the petitioner was

Patna High Court Cr.Misc. No.27301 of 2018 (3) dt.21-06-2018 2/2 earlier rejected by a co-ordinate Bench of this court vide order dated 16.09.2014 passed in Cr. Misc. No. 27262 of 2014 and no change circumstance has been brought before me to differ with the previous order of this court. Hence, the prayer for anticipatory bail of the petitioner stands rejected.
