JUSTICE VIKASH JAIN ORAL JUDGMENT Date : 25-02-2021 The following reliefs as formulated by the petitioner have been claimed in the writ petition - "(i) For issuance of writ in the nature of mandamus or any other appropriate writ, order or direction to the respondents to revise the family pension of the petitioner on account of death of her husband Late Dubraj Devgam

Patna High Court CWJC No.6611 of 2017 dt.25-02-2021 2/3 after grant of benefits of 6th pay commission to the salary of late Dubraj Devgam from the due date i.e. 01.01.2006 and the revised family pension and arrears of family pension be paid to the petitioner.

(ii) For issuance of writ in the nature of mandamus or any other appropriate writ, order or direction to the respondents to grant the benefit of the Assured Career Progression to the deceased husband of the petitioner Late Dubraj Devgam who was entitled for 1st Assured Career Progression on his completion of 12 years in employment without being granted any promotion in his service period and accordingly the salary of Late Dubraj Devgam be revised and the revised arrears of salary as well as the revised family pension and its arrears be paid to the petitioner.

(iii) For issuance of any other appropriate writ, order or direction which your Lordships may deem fit and proper in the facts and circumstances of the case."

2. None appears on behalf of the petitioner when the matter is called. On the last occasion on 28.02.2021 as well, the petitioner was not represented.

3. Pursuant to order dated 07.01.2021, second supplementary counter affidavit has been filed on behalf of the State. Learned counsel for the State refers to paragraph-11 of the said affidavit in which it is stated that the bills for the amount in question have been sent to the Treasury for payment through CFMS system and as such the grievances of the petitioner stands redressed.

4. Having regard to the statement made on behalf of the State as aforesaid, the writ petition stands disposed of. It is made clear that the petitioner shall be at liberty to seek recall of this judgment in the event that the statement made in the aforesaid affidavit of the State is found incorrect.
