JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 21-02-2023 By way of filing affidavit, it has been brought on record that petitioner was granted provisional bail vide order dated 14.12.2022 and he was required to surrender on 04.01.2023 but he could not surrender within time due to fracture in his left leg. He has prayed for extension of period of provisional bail.

Prosecution case relates to assaulting by the petitioner to the informant by means of spade as a result of which he received injury on his head, arm and right leg. When his son came there to protect him, he was also beaten by the petitioner and snatched his gold chain and 3,000/- Rs.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. The

Patna High Court CR. MISC. No.65174 of 2022(3) dt.21-02-2023 2/2 present case is counter blasét of S.Kamal P.S. Case No. 77 of 2022 and 231 of 2022. Except one injury, all injuries are simple in nature. As per medical report, injuries caused by hard and blunt object, whereas allegation is of assaulting by means of knife, which is contradictory.

Having heard the case on merit, the provisional bail granted to the petitioner vide order dated 14.12.2022 is hereby confirmed.

The application stands allowed.
