JUSTICE SANJAY PRIYA ORAL ORDER 4/ 09-05-2018 Heard learned counsel for the petitioner and learned counsel for the Vigilance.

Petitioner apprehends her arrest in Bibhutipur P.S. Case No.124 of 2017 instituted for the offence under Section(s) 420, 467, 468, 471, 120-B Indian Penal Code.

Counsel for the petitioner has submitted that other accused persons with similar allegation in another case has been granted anticipatory bail by co-ordinate Bench of this Court as well as by this Court.

In the instant case, there is allegation that petitioner got appointment on the basis of forged TET Certificate and Serial Number of the Certificate did not tally with the report of the Bihar School Examination Board.

No.18594 of 2018 (4) dt.09-05-2018 2/3 Counsel for the petitioner has submitted that petitioner was suspended from the service after institution of First Information Report and thereafter she has tendered resignation letter. Counsel for the petitioner has further submitted that she has submitted TET Certificate, which was received by her. Learned counsel for the Vigilance has submitted that investigation has already been completed in the case. In the facts and circumstances of the case, prayer of the petitioner for grant of anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today in connection with Bibhutipur P.S. Case No.

124 of 2017, she shall be released on anticipatory bail on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-IV, Samastipur, subject to the conditions as laid down under Section 438(2) Cr. P. C.

Patna High Court Cr.Misc. No.18594 of 2018 (4) dt.09-05-2018 3/3 with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.

The authority concerned will be at liberty to realize the money from the petitioner, in accordance with law, in the event, she has received money during the period of her working on the basis of certificate, which was not found genuine. (Sanjay Priya, J) JA/- U T
