The petitioner has renewed his prayer for grant of regular bail in a case registered under section 392 of the Indian Penal Code and sections 25(1-B)(a) and 26 of the Arms Act. The earlier application for bail of the petitioner was rejected vide order dated 7.4.2022 passed in Cr. Misc. no. 57515 of 2021.

As per the prosecution case, four accused persons on the point of pistol snatched Rs.600/- from the possession of the informant. While the two accused persons including the petitioner herein were caught, two managed to escape. It is submitted by learned counsel for the petitioner that in the order of rejection dated 7.4.2022 (Annexure-1),

Patna High Court CR. MISC. No.66343 of 2022(2) dt.30-11-2022 2/2 liberty was granted to the petitioner to renew his prayer for bail after six months. The petitioner has remained in custody since 18.5.2021, has no criminal antecedent and it has been more than six months since passing of the said order granting liberty. Heard learned A.P.P for the State.

Having heard learned counsel for the parties and taking into consideration the nature of allegation, the liberty granted by the aforesaid order dated 7.4.2022 together with the petitioner having remained in custody for over one year, the petitioner is directed to be enlarged on bail in connection with Jakkanpur P.S. Case no.232 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-I, Patna.
