JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-05-2018 The petitioner is apprehending his arrest in connection with Patna City Chowk P.S. Case No. 332 of 2017, registered for offences punishable under Sections 365 of the Indian Penal Code. Allegation against the petitioner and others is of abducting and committing murder of the son of the informant. It has been submitted on behalf of the petitioner that he has not been named in the F.I.R. and his name has transpired in this case on confession of co-accused and except that there is nothing against the petitioner to show his involvement in the present case.

Learned counsel for the State opposed the prayer for bail. Having heard both sides, considering the facts and circumstances of the case, nature of offence and also that

Patna High Court Cr.Misc. No.21156 of 2018 (3) dt.08-05-2018 2/2 petitioner has criminal antecedents as he is an accused in several other cases, as such, I am not inclined to grant the privilege of anticipatory bail to the petitioner, this application is accordingly dismissed.

However, the petitioner may surrender before the court below and pray for regular bail, which will be considered by the court below on the merit of the case.
