The petitioner has preferred this application for grant of regular bail in connection with Gopalganj Town P.S. Case No. 111 of 2021, G.R. No. 617 of 2021, dated 15.02.2021 registered for the offences punishable u/ss 302 and 201 read with Section 34 of the Indian Penal Code.
As per the prosecution case, the niece of the informant went to the market and the next day, her dead body was found hanging on the tree and the F.I.R. was registered against unknown persons.
Patna High Court CR. MISC. No.70948 of 2022(2) dt.05-04-2023 2/2 Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the F.I.R. The name of the petitioner has sprung up in this case during the course of investigation. The co-accused person has already been granted bail by the Coordinate Bench vide order dated 20.09.2022 passed in Cr. Misc. No. 68153 of 2021. The petitioner is accused in one more criminal case as stated in para 4 of the supplementary affidavit filed on behalf of the petitioner. The petitioner is in custody since 26.05.2022. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Gopalganj in connection with Gopalganj Town P.S. Case No. 111 of 2021, G.R. No. 617 of 2021.
The application stands allowed.
