2. In the present case, the petitioner seeks bail in connection with Buddha Colony P.S. Case No. 415 of 2023, registered for the offences under Sections 392 of the Indian Penal Code.
3. As per the prosecution case, three miscreants riding two motorcycles on gunpoint snatched mobile phone, wallet containing Rs.5,000/-, ATM card, Aadhaar card, PAN card, driving license and owner book of the bike of the informant from the informant. Robbers also took away one bluetooth device and helmet of the informant. The name of the petitioner transpired for being involved in this case during investigation.
4. Learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.64998 of 2025(2) dt.18-09-2025 2/3 petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Nothing incriminating has been recovered from person or possession of the petitioner. No Test Identification Parade has been conducted by the police till date. There is no material to show that the petitioner committed the robbery. The name of the petitioner transpired in this case in the confessional statement of co-accused Sonu Kumar and except that there is no material against the petitioner to show the involvement of the petitioner in the alleged crime. Petitioner has antecedent of four cases and he is on bail in all these cases. The petitioner is in custody since 13.03.2024 and charge sheet has been submitted.
5. Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioner.

Having regard to the fact and circumstances and submission made on behalf of the parties and considering the fact that no recovery has been shown from this petitioner and also considering submission of charge sheet and period of custody, the petitioner is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IV, Patna/concerned court, in
Patna High Court CR. MISC. No.64998 of 2025(2) dt.18-09-2025 3/3 connection with Buddha Colony P.S. Case No. 415 of 2023, subject to the condition laid down under Section 480(3) of the BNSS and other following conditions:
(i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
