2. The petitioner seeks bail in a case registered for the offence punishable under Sections-341, 323, 324, 307, 384, 302 and 34 of the Indian Penal Code.
3. The petitioner is father of the co-accused Chandan Yadav. According to allegation, the petitioner and his son, Chandan Yadav alongwith 2-3 unknown persons attacked Krishna Sah, the uncle of the informant with intention to kill as a result of which, the said Krishna Sah sustained a number of injuries and was taken to PMCH, Patna where he died in course of treatment after 17 days of the occurrence. .
4. It has been submitted on behalf of the petitioner
Patna High Court CR. MISC. No.65713 of 2025(3) dt.06-01-2026 2/2 that the co-accused Chandan Yadav faced trial in S. Tr. No. 412 of 2024 and vide detailed judgment and order dated 05-03-2025, he was acquitted as because, the informant did not support the case. Learned counsel for the petitioner has also submitted that charges have been framed and the petitioner is under incarceration since 29-07-2025.
5. Learned APP has opposed the prayer for bail.
6. From perusal of judgment and order dated 05-032025 passed in Sessions Trial No. 412 of 202024, it appears that the co-accused Chandan Yadav faced trial and having similar allegation, he has been acquitted by the trial court.
7. Considering the aforesaid facts and circumstances, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, West Champaran at Bettiah in connection with Bettiah (Mufassil) P.S. Case No. 46 of 2024 subject to condition that the petitioner shall appear before the trial court on each and every date, fixed by the court.
