JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 24-02-2023 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 363, 365 of the IPC later on converted under sections 302/201/34 of the Indian Penal Code.

As per prosecution case, the allegation against the petitioner is that she kidnapped the father of the informant and later on the murder of the informant's father done by the petitioner along with co-accused persons.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is not named in FIR rather she has falsely been implicated in the present case on the basis of suspicion. The name of the petitioner has transpired in this case on the basis of

Patna High Court CR. MISC. No.65092 of 2022(2) dt.24-02-2023 2/2 confessional statement of one Rahul Kumar, thereafter the petitioner has been arrested. From perusal of FIR, it is apparent that initially the name of said Pappu Singh was mentioned in the accused column but later on, the same was deleted and was registered against unknown which also creates doubt. The petitioner has got no criminal antecedent. It is further submitted that the petitioner is a lady and she is languishing in judicial custody since 22.6.2022.

Learned APP appearing for the state and learned counsel for the informant have vehemently opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Gaurichak P.S. Case No. 406 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VI, Patna City.
