On 10.01.2020 when the matter was called out there was no representation on behalf of the petitioner, but this Court had adjourned the matter by way of last indulgence. In the present case, the petitioner is seeking quashing of the First Information Report being Dehri SC/ST P.S. Case No. 57/2016 lodged on 19.08.2016 for the alleged offences

Patna High Court CR. WJC No.688 of 2017(4) dt.21-07-2022 2/2 under Sections 147, 148, 149, 323, 504, 506 of the Indian Penal Code and Section 3(i)(R)(S) of SC/ST Act.

There is no information as to whether the investigation in the present case is complete and charge-sheet has been filed or not.

Learned counsel for the State is present.

In the present circumstances where the petitioner is not taking any interest in pursuing the matter and the case has remained pending for over five years by now, this Court deems it just and proper to dispose of this writ application with liberty to the petitioner that he may seek his remedy, if so advised, after completion of investigation and any other and further cause of action.
