JUSTICE SHIVAJI PANDEY ORAL ORDER 12-07-2017 Heard learned counsel for the petitioner and counsel for the State as also counsel for the Informant.
In this case, the petitioner is apprehending his arrest in connection with Siwan (Town) P.S. Case No. 693 of 2016 for offence under Sections 302, 201/34 of the Indian Penal Code. The sister of the deceased received information that her brother has been killed by Ajit and Saddam and they were captured by the villagers. She also disclosed two extra names and, later on, during investigation, in para-66 & 67, the statement of two witnesses have been recorded which shows involvement of the petitioners in the death of the deceased. The dispute has taken place on account of selling of Ganja.
Patna High Court Cr.Misc. No.20537 of 2017 (5) dt.12-07-2017 At this stage, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.
Accordingly, the prayer for anticipatory bail of the petitioners, namely, Raunak is rejected.
If the petitioner surrenders before the court below within a period of four weeks from today, the court below will consider the prayer for bail of the petitioner and pass an order in accordance with law without being prejudiced by this order. (Shivaji Pandey, J) Rishi/- U T
