JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-05-2018 The petitioner is apprehending his arrest in connection with Madhepura P.S. Case No. 120 of 2017, registered for offences punishable under Sections 419 and 420 of the Indian Penal Code.

Allegation against the petitioner that he allowed other coaccused, namely, Shashi Kumar to appear in the intermediate examination in his place and the said Shashi Kumar was arrested, who disclosed the name of petitioner.

It has been submitted on behalf of the petitioner that he has no concern with the said Shashi Kumar and though he has named this petitioner but it has not been disclosed as to who asked him to appear in the examination in place of petitioner. Heard learned A.P.P. also.

No.21635 of 2018 (3) dt.08-05-2018 2/2 Having heard both sides, considering the facts and circumstances of the case, nature of accusation, I am not inclined to grant the privilege of pre arrest bail to the petitioner rather this application is disposed of with direction to the petitioner to surrender before the court below and make prayer for regular bail and if any such application is filed the court below after considering the same shall pass an appropriate order on the merit of the case, preferably on same day, without being prejudiced by the order of this Court.
