JUSTICE SANJAY PRIYA ORAL ORDER 19-06-2018 Heard learned counsel for the petitioner, learned counsel for the BSFC and learned counsel for the State. The petitioner apprehends his arrest in Hilsa P.S. Case No. 68 of 2018 instituted for the offence under Sections 420, 409 and 120B of the Indian Penal Code.

Learned counsel for the petitioner has submitted that from the First Information Report itself it would be apparent that entire responsibility of maintaining stock in the godown was of Block Agriculture Officer-cum-Assistant Godown In-charge. The petitioner was working as Executive Assistant in the aforesaid godown on contractual basis. As per Annexure-4 there was

No.26519 of 2018 (3) dt.19-06-2018 2/2 specific direction not to give any responsibility of important work to the petitioner and other employees who were working as Executive Assistant. The aforesaid letter has been enclosed as Annexure-4. Learned counsel for the petitioner has pointed out Annexure-5 issued by Block Agriculture Officer wherein it is mentioned that nothing is recoverable from this petitioner in the financial year 2015-16 and 2016-17 as no misappropriation has been done by him during that period.

Considering the facts and circumstances of the case, the provisional anticipatory bail granted to the petitioner vide order dated 08.05.2018 passed by coordinate Bench of this Court in connection with Hilsa P.S. Case No. 68 of 2018 is hereby confirmed on same terms and conditions.
