Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

This application for regular bail arises out of Pupari P.S. Case No.211 of 2022 disclosing offence punishable under Sections 461,379/34 of the Indian Penal Code. The petitioner is in custody since 31.07.2022. It is the prosecution's case that in between 1 o'clock to 3 o'clock in the night of 01.07.2022, five-six miscreants entered into the shop and godown of the informant and others after breaking open the shutter of the shop and godown, they are said to have taken away the stolen articles in a blue car. Learned counsel appearing on behalf of the petitioner has submitted that the offence is triable by a Magistrate. He has already remained in custody for more than six months. Considering the circumstance that the offence is triable by a Magistrate and the petitioner has remained in custody since 31.07.2022, this application is allowed. Considering the above, this application is allowed. Let the petitioner above-named be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand), with two sureties of the like amount, each to the satisfaction of learned Subdivisional Judicial Magistrate, Pupri, Sitamarhi in Pupri P.S. Case No. 211 of 2022.
