2. The petitioners have prayed for regular bail in a case registered for the offence punishable under section 30 (a) of the Bihar Prohibition and Excise Act.

3. The case of the prosecution is that altogether 110 liters of country made liquor was recovered from the motorcycle.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that petitioner no. 1 was driving the vehicle while petitioner no. 2 was merely sitting as a pillion rider. It is further submitted that

Patna High Court CR. MISC. No.65018 of 2025(2) dt.23-09-2025 2/2 nothing has been recovered from the conscious possession of the petitioners. Moreover, the petitioner is languishing in judicial custody since 27.07.2025 having no criminal antecedent.

5. Learned APP appearing for the State has opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Excise P.S. Case No. 460, C2/25 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned District and Additional Sessions Judge -VII cum Exclusive Special Excise Court No. II, Lakhisarai.
