JUSTICE SUDHIR SINGH ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date: 04-05-2017 In the matter of seeking allotment of land by BIADA, on account of the fact that merely because the land is lying vacant, no statutory or constitutional right accrues to the petitioner for release of that acquired land, which is taken over by BIADA for industrialization and the industrial development, the Writ Court having dismissed the writ petition, we see no reason to make any indulgence into the matter.

Patna High Court LPA No.815 of 2016 dt.04-05-2017 2/2 Apart from the aforesaid, there is no reasonable explanation of delay of four years in filing of the appeal. Taking into all the totality of the circumstances, we see no reason to make any indulgence into the matter.
