2. The petitioner apprehends his arrest in connection with Patrakar Nagar P.S. Case No. 146 of 2023, registered for offence punishable under Sections 356/379 of the Indian Penal Code.
3. Allegedly, while the informant was returning from school with his child, two unknown accused persons snatched away gold chain from his possession.
4. The learned counsel for the petitioner has submitted that nothing has been recovered from the possession of the petitioner and the entire material emerged against him during the course of investigation is only the confessional statement of
Patna High Court CR. MISC. No.69903 of 2023(2) dt.01-11-2023 2/2 co-accused Sanjay Sah. He has been made accused only on the basis of his criminal antecedent disclosed in paragraph 3 of the bail petition, in which he is on bail.
5. On the other hand, the learned APP has opposed the prayer for bail.
6. Considering the above-mentioned facts and circumstances, the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Patna in connection with Patrakar Nagar P.S. Case No. 146 of 2023, subject to condition as laid down under section 438(2) Cr. P.C. Further condition is that the petitioner shall physically present before the court below on each and every date till framing of the charge. (Nawneet Kumar Pandey, J) Mahesh/- U T
