JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 28-04-2015 This application was filed seeking anticipatory bail as the petitioner is an accused in a case registered for the offences punishable under Section 498A of the Indian Penal Code and section 4 of the Dowry Prohibition Act.
By an order dated 05.11.2014, the matter was referred to Patna High Court Mediation Centre for resolution of the dispute between the parties. The learned Mediator has submitted a report dated 27.4.2015 annexing compromise between the parties from which it appears that the parties have resolved their disputes by way of one time settlement.
Learned counsel appearing on behalf of Opposite party no.2 submits that in view of the resolution of dispute through the process of Mediation, the Opposite party no.2 does not intend to proceed with the criminal case any further.
Be that as it may, this being an application for grant of
Patna High Court Cr.Misc. No.47932 of 2013 (11) dt.28-04-2015 anticipatory bail, the same is allowed. Let the petitioner above named in the event of his arrest/surrender without four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M, Patna complaint case No. 453(C) of 2012, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
It will be open to the parties to proceed further in terms of the mutual settlement agreed upon the parties before the learned Mediator.
