In the present writ application, the petitioner has prayed for grant of following relief:- "For issuance of a Writ in the nature of a Writ of Mandamus, or any other appropriate Writ order, direction commanding the Respondents, to rename the Madhya VidyalayaKathchatar, Lilatari, Banka, in the name of Grandfather of the Petitioner namely Late KapuriRao, as the land for the school was gifted in the name of

Patna High Court CWJC No.19625 of 2019(4) dt.18-06-2026 2/3 KapuriRao, on account of which earlier the School was Kapuri Uchcha PrathamikiVidhyalay, but the Government arbitrary changed the name of the School, without any notice to the Grand Father of the Petitioner."

After advancing some argument, learned counsel for the petitioner submits that the petitioner would be satisfied if the petitioner is permitted to file a fresh representation before the District Magistrate, Banka for seeking the aforesaid relief. He further prays that if this Court permits the petitioner to file a fresh representation, then an appropriate direction be also issued to the District Magistrate, Banka, to dispose of the representation within a fixed time-frame, after giving an opportunity of hearing to the petitioner.

4. To the aforesaid submission made by the learned counsel for the petitioner, learned counsel appearing for the respondent-State does not have any objection.

Considering the limited nature of the prayer made by learned counsel for the petitioner, this writ application is disposed of, granting liberty to the petitioner to file a fresh representation before the District Magistrate, Banka for claiming the relief, which the petitioner has prayed for in the

Patna High Court CWJC No.19625 of 2019(4) dt.18-06-2026 3/3 present writ application. Such a representation must be filed by the petitioner within one month from the date of passing of this order. If such a representation is filed, the same shall be disposed of by the District Magistrate, Banka within a period of six months from the date of filing of the representation, after giving an opportunity of hearing to the petitioner.

Needless to emphasize that the final order, which shall be passed by the District Magistrate, Banka, should be a reasoned and speaking order, and in case the petitioner is found entitled to the relief, which the petitioner would be claiming through the representation, then the same should be extended to the petitioner within a further period of six months from the date of passing of the final order.

7. With the aforesaid observation/direction and liberty granted, this writ application stands disposed of.
