JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-07-2018 The petitioner is apprehending his arrest in connection with Complaint Case No. 2477/2015, registered for offences punishable under Sections 406 and 417 of the Indian Penal Code. Allegation against the petitioner as per F.I.R. that a sale deed was executed in favour of the complainant with respect to certain piece of land by co-accused of this case and after possession, he came to know that the land did not belong to the said co-accused and allegation against this petitioner that he is a broker and at his instance the sale deed was executed. It has been submitted on behalf of the petitioner that the sale deed was executed by other person and he has been granted the privilege of anticipatory by a coordinate Bench of this Court vide order dated 09.11.2016 passed in Cr. Misc. No. 18581 of 2016 and petitioner being the broker, has nothing to do with the

Patna High Court Cr.Misc. No.21320 of 2018 (4) dt.12-07-2018 2/2 allegation.

Heard learned A.P.P. also.

None has appeared on behalf of the complainant in spite of notice.

Having heard both sides, considering the facts and circumstances of the case, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Purnea in connection with Complaint Case No. 2477/2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C, it is further subject to the condition that:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
