The petitioners apprehend their arrest in connection with Special Case No. 5373 of 2019 arising out of Bakhatiyarpur P.S. Case No. 193 of 2019 registered under Section 328/120B of the Indian Penal Code and section 30(a)(c) (d) of the Bihar Excise Act.

Learned counsel appearing on behalf of the petitioners submits petitioners are innocent and have falsely been implicated in the present case. Further submission is that on perusal of seizure list, it appears that nothing has been recovered from the possession of these petitioners. Petitioners

Patna High Court CR. MISC. No.61437 of 2019(2) dt.16-10-2019 2/2 have no concern with the seized materials and they have no criminal antecedent.

Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Patna in connection with Special Case No. 5373 of 2019 arising out of Bakhatiyarpur P.S. Case No. 193 of 2019, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
