2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 363 and 366 (A) of the IPC .
3 . The prosecution case in brief is that all the F.I.R. named accused persons, including these petitioners kidnapped minor daughter of informant.
4. Learned counsel for the petitioners submits that the petitioners are innocent and has falsely been implicated in this case . It is further submitted that the victim in her statement recorded under Section 164 of the Cr.P.C. has denied the
Patna High Court CR. MISC. No.69966 of 2024(3) dt.07-01-2025 2/2 prosecution case and has categorically stated that she is in love with co-accused Dhiraj Kumar and she on her own will solemnized marriage with him after fleeing away from her parental house . Petitioners claim clean antecedent. 5 . Learned counsel for the State opposes the prayer for bail.

Considering the 164 Cr.P.C. statement of the victim, clean antecedent of the petitioners and other circumstances of the case , in the event of arrest or surrender within eight weeks from today , let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM- IV Gaya in connection with MMCH P.S. case No. 169 of 2020, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
