JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 27-02-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 354/34 of the Indian Penal Code and Section 12 of the POSCO Act.

It is alleged against all the F.I.R named accused persons including the petitioner that they misbehaved with the informant while she was returning home after taking cow-milk.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely

The petitioner is a student of B.Sc and he has no role in the occurrence. Moreover, for the alleged occurrence of 27.09.2021, F.I.R has been registered on 02.10.2021 without explaining the delay. The petitioner is languishing in custody since 13.10.2022. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VI-cum-Special Judge, POCSO, Vaishali at Hajipur in connection with Town P.S.
