2. 0.31g of smack has been recovered from the possession of the petitioner and the petitioner is in custody since 6.12.2022.

3. In view of the fact that the recovery is of small quantity the petitioner is permitted to withdraw this application and given liberty to file an application before the Special Judge for pleading guilty and in case, such an application is filed, the same shall be decided on the same date by the Special Judge and the Special Judge will consider the period of custody and pass an order in accordance with law. It may the consider awarding the sentence of period undergone to the petitioner.
