2. The petitioners seek bail in connection with Sonpur P.S. Case No. 341 of 2023 registered for the offence under Sections 302, 34 of the Indian Penal Code.

3. It has been alleged that the petitioners along with other accused persons have assaulted the deceased.

4. Learned counsel for the petitioners submits that the petitioner no.1 is 80 years old and the petitioner no.2 is a lady. There is general and omnibus allegation of assault against the petitioners and they are in custody since 14.05.2023.

5. Learned counsel for the informant and the

Patna High Court CR. MISC. No.69444 of 2023(2) dt.01-11-2023 2/2 learned A.P.P. have vehemently opposed the prayer for bail and they have submitted that the petitioners along with others have killed the deceased, and therefore, they do not deserve bail.

6. Considering the age of the petitioner no.1 and the fact that the petitioner no.2 is a lady, this application for regular bail is allowed.

7. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Sonpur P.S. Case No. 341 of 2023.

8. The petitioners will cooperate in the proceeding of the court below. In the event of failure to appear on two consecutive dates, the court below will be at liberty to pass appropriate order including cancellation of bail bonds of the petitioners.
