The petitioner apprehends his arrest in a case registered for the offence under Sections 302, 201, 120(B) of the Indian Penal Code.
The prosecution case, in brief, is that on 09.07.2022 at about 4:00 PM, this petitioner alongwith other co-accused persons have taken away the grandson of informant for doing labour work and on the next date, the dead body of informant's grandson was found lying near the Middle School of Bhandar. It is alleged that this petitioner alongwith other co-accused persons committed the murder of grandson of informant. It is submitted on behalf of petitioner that informant is not eye-witness of the occurrence and only on suspicion,
Patna High Court CR. MISC. No.65564 of 2022(3) dt.11-05-2023 2/2 petitioner and others have been made accused in this case. During course of investigation, nothing surfaced against this petitioner to show his involvement in the alleged crime. Doctor has not found any external injury on the body of the deceased. Petitioner claims clean antecedent.
However, learned A.P.P. for the State and learned counsel for the informant vehemently opposed the bail petition and submitted that petitioner is named in the F.I.R., who had taken away the grandson (deceased) of the informant, whose dead body was found on the next date. During investigation, many witnesses have supported the prosecution case. Considering the aforesaid facts and circumstances, the prayer for anticipatory bail of petitioner is rejected.
