1. Heard learned counsel for the petitioner and the learned A.P.P. for the State.

2. The petitioner apprehends his arrest in connection with Maniyari P.S. Case No. 222 of 2023 registered under Section 30(a) of the Bihar Prohibition and Excise Act.

3. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case due to dirty village politics. The alleged illicit wine has been recovered near the temple. Petitioner has no concern either with the recovered wine or motorcycle. Further he submits that petitioner has no criminal antecedent.

4. Having considered the facts and circumstances

Patna High Court CR. MISC. No.68107 of 2023(2) dt.01-11-2023 2/2 of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the concerned Court within a period of four weeks from today, on furnishing personal bond to the satisfaction of the Exclusive Special Excise Court No. II, Muzaffarpur in connection with Maniyari P.S. Case No. 222 of 2023, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
