JUSTICE ARVIND SRIVASTAVA ORAL ORDER 27-11-2017 Heard learned counsels for the petitioner and the State. Petitioner seeks bail in connection with Shastri Nagar P.S. Case No. 639 of 2015 registered for the offence punishable under sections 420, 467, 468, 471 and 120B of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case on basis of his confessional statement made before the police, which has no evidentiary value in the eye of law. As a matter of fact, no fraudulent transactions have been made from the account of the petitioner, and as such, there is no question of involvement of this petitioner in the alleged offence. Moreover, charge sheet has already been submitted in this case. Petitioner is languishing in custody since 08.03.2016.

Aditi Gupta, Judicial Magistarte, 1st Class, Patna in connection with Shastri Nagar P.S. Case No. 639 of 2015 subject to the conditions laid down under section 438(2) Cr.P.C.
