2. In the present case, the petitioner seeks bail in connection with Sessions Trial No. 42 of 2024, arising out of Noorsarai P.S. Case No. 199 of 2023 registered for the alleged offences under Section 392 of the Indian Penal Code. However, charge sheet has been submitted under Sections 395/412 of the Indian Penal Code.
3. As per prosecution case, three persons on gun point snatched the E-rickshaw of the informant. Subsequently, the name of the petitioner surfaced as one of the accused persons in the present case.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.69494 of 2025(2) dt.08-10-2025 2/3 petitioner is innocent and has been falsely implicated in this case. Nothing incriminating has been recovered from the person or possession of the petitioner. The petitioner has a quarrel with the informant and for this reason, the petitioner was identified along with other co-accused persons for being involved in the alleged occurrence by the informant. The petitioner is in custody since 08.06.2023 and due to poverty, he could not move for bail before this Court earlier. Similarly placed co-accused persons have been granted bail vide orders dated 29.02.2024, 24.01.2025 and 11.04.2025 passed in Cr. Misc. Nos. 78436 of 2023, 82777 of 2024 and 14352 of 2025, respectively by different Co-ordinate Benches. The case of the petitioner is on similar footing. The petitioner is having antecedent of five cases and charge sheet has been submitted.
5. Learned APP opposes the submission made on behalf of the petitioner. Learned APP submits that the petitioner has been identified by the informant in Test Identification Parade.
6. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the period of custody of the petitioner and submission of charge sheet, the petitioner above named is directed to be released on
Patna High Court CR. MISC. No.69494 of 2025(2) dt.08-10-2025 3/3 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge 11th, Nalanda at Biharsharif/concerned Court in connection with Sessions Trial No. 42 of 2024, arising out of Noorsarai P.S. Case No. 199 of 2023, subject to the conditions mentioned in Section 480(3) of B.N.S.S. and also the following conditions :
(i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below. (iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
