JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 27-01-2022 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State through video conferencing.

The petitioner apprehends his arrest in connection with Vaishali Complaint Case No. 344 of 2019 registered for offence punishable under sections 323, 504, 506, 498(A) and 509 of the Indian Penal Code.

It is a case of matrimonial dispute. The matter was referred to the Patna High Court Mediation Centre. The report dated 16.12.2021 of the Patna High Court Mediation Centre is at flag 'A'. It appears that both the parties have compromised their

Patna High Court CR. MISC. No.63906 of 2019(6) dt.27-01-2022 2/2 case on 16.12.2021. The victim Amrita Devi went to her matrimonial house. As per terms of compromise, the petitioner has also agreed to bear all the expenses of his daughter, including her education etc.

Considering the above mentioned facts and circumstances, the petitioner above named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Complaint Case No. 344 of 2019, subject to condition as laid down under section 438(2) Cr. P.C. Further condition is that if the learned court below finds that the petitioner has reflected the terms of the compromise, the learned court below is free to take steps against him in accordance with law.
