====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 13-10-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in connection with Sheikhpura P.S. Case No. 279 of 2020 dated 08.07.2020 registered for the offences punishable under Sections 302, 201 read with Section 34 of the I.P.C. and Section 27 of the Arms Act.

3. As per the prosecution case, the husband of the informant was shot and his dead body was found lying in Murjaina Khanda and further the informant named the coaccused Aarif Miyan for being involved in the occurrence due to previous land dispute. The informant has also alleged that the co-accused Aarif Miyan had also threatened in the past to kill

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is further submitted that the petitioner is not named in the F.I.R. His name has surfaced in the present case during the course of investigation after five years of the alleged occurrence due to dirty village politics. There is no eye witness to the alleged offence. It is further submitted that the other coaccused persons, namely, Arif Miyan @ Arif Raja @ Arif Raza who has been named in the F.I.R. in Cr. Misc. No. 32350 of 2021 vide order dated 22.02.2022 and Chandan Kumar @ Chandan Yadav in Cr. Misc. No. 17267 of 2025 vide order dated 26.03.2025 have already been granted anticipatory bail by another Co-ordinate Benches of this Court, annexed as Annexures-P/3 and P/4 to the present bail application.

It is further submitted that similarly situated co-accused person, namely, Sujit Kumar @ Laldhar has also been granted bail in Cr. Misc. No. 17150 of 2025 vide order dated 15.05.2025 by another Co-ordinate Bench of this Court, annexed as AnnexureP/5 to the present bail petition. No incriminating article has been recovered from the possession of the petitioner. The petitioner has clean antecedent as stated in paragraph no.

Patna High Court CR. MISC. No.65905 of 2025(3) dt.13-10-2025 3/3 petition. He is in custody in this case since 01.08.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Sheikhpura in connection with Sheikhpura P.S. Case No. 279 of 2020.

7. The application stands allowed.
