JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-12-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 413, 414/34 of the Indian Penal Code.

No doubt, petitioner and one co-accused Guddu Kumar were caught with a motorcycle which is said to be stolen one but submission on behalf of the petitioner is that the aforesaid motorcycle belongs to father of the petitioner and the same has already been released in favour of father of the petitioner. It is further pointed out by him that co-accused Guddu Kumar has already been granted privilege of bail by a co-ordinate Bench of this court.

No.62226 of 2019(2) dt.04-12-2019 2/2 Considering the aforesaid facts and circumstances as well as this aspect of the matter that petitioner is in jail custody since 08.07.2019 and does not have any criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III (West) cum Sub-Judge, Muzaffarpur in connection with Paroo P.S. Case No. 276 of 2019.
