JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-06-2018 Petitioners apprehend their arrest in connection with Complaint Case No. 215c of 2017 lodged for the offences punishable under Sections 147, 323, 384, 420, 467, 468, 448 and 504 of the Indian Penal Code.

Allegation against the petitioner No.1 is that he has sold land to the complainant which was sold earlier and petitioner No.2 is earlier purchaser and petitioner No.3 is identifier. Submission of learned counsel for the petitioners is that there is delay of six months in lodging the complainant and further land belonged to the share of petitioner No.1.

Patna High Court Cr.Misc. No.21329 of 2018 (3) dt.26-06-2018 2/3 Heard learned APP and learned counsel for the informant, who has opposed the prayer for anticipatory bail of the petitioners stating that opposite party No.2 has purchased the land from the person who has already purchased the same from grandmother of petitioner No.1 and now it has again been sold by the petitioner.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioners, named above, surrender within a period of six weeks from the receipt of this order and on their so surrendering they shall be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa, in connection with Complaint. Case No. 215c of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions are that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
