JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Baniyapur P.S. Case No. 205 of 2019 registered for the offences punishable under Sections 461 and 379 of the Indian Penal Code.

As per FIR there is allegation of committing theft of articles worth more than Rs. 2 lac in the shop of the informant and petitioner is not named in the FIR but later on his name transpired in the confessional statement of co-accused. Submission of learned counsel for the petitioner is that except confessional statement of co-accused there is nothing against him, there is no recovery from him and he has no criminal antecedent.

In view of above facts and circumstances, this

Patna High Court CR. MISC. No.62742 of 2019(2) dt.15-10-2019 2/2 application is disposed of with direction to the petitioner to surrender within two weeks and on surrender learned court below shall verify the above submission that except confessional statement there is nothing against him and he has no criminal antecedent and if it is found to be true, learned court below shall release him on bail to its own satisfaction.
