2. The accused/petitioner seeks bail in connection with S.T. No. 257/2011 arising out of K.Hat P.S. Case No. 334 of 2010 registered for the offences under Sections 363, 366A/34 of the Indian Penal Code.

3. The accused/petitioner is named in the First Information Report and is in custody since 29.07.2025 on surrender for misusing of bail as he left the court proceeding on 02.06.2023.

4. It is submitted by Mr. N.K. Agrawal, learned senior counsel appearing on behalf of the petitioner that due to certain communication gap between petitioner and his

5. It is pointed out by Mr. Agrawal, that absence of petitioner was neither intentional nor deliberate rather due to sufficient cause duly explained through petition. It is pointed out that occurrence is of the year 2010, but not even a single prosecution witness was examined by the learned trial court in this matter.

6. Learned A.P.P. for the State has opposed the prayer for bail of the petitioner.

In view of aforesaid factual submission and by taking note of the fact as this is the first misuse of this petitioner, accordingly, above-named petitioner is directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned District & Additional Sessions Judge-X, Purnia/concerned court, in connection with S.T. No. 257/2011 arising out of K.Hat P.S. Case No. 334 of 2010, subject to the condition as laid down under Section 437(3) Cr.P.C/Section 480(3) of the Bhartiya

(i) Accused/Petitioner shall cooperate in the trial and shall be physically present on each and every date before the Trial Court till conclusion of the trial and exemption from physical appearance be allowed by the Trial Court, only on medical ground of the petitioner duly supported by the documents.
