1. Heard learned counsel for the petitioner and the State.
2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 384, 504, 506 of the Indian Penal Code.
3. As per the prosecution case, petitioner along with other co-accused alleged to have tortured and harassed the informant mentally and physically. It is further alleged that petitioner used to post misleading information with intention to tarnish the image of the informant.
4. It is submitted on behalf of the petitioner that allegation is very vague and general. No specific date and time has been given in F.I.R. as to when and where the informant was threatened and in what manner tortured. As a matter of fact,
Patna High Court CR. MISC. No.69475 of 2023(2) dt.01-11-2023 2/2 father of the petitioner filed a complaint case against the infromant vide C.R. No. 1226 of 2021 dated 21.08.2023 in which cognizance has been taken which is presently pending in the court below and in revenge, this false case has been lodged against the petitioner. Informant is relative of Dinesh Choudhary with whom father of the petitioner has old land dispute. There is no allegation of overt act and only suspicion has been raised.
5. Learned APP for the State vehemently opposed the prayer of bail.

Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of J.M. 1st Class, Samastipur/concerned court below in connection with Patori P. S. Case No. 302 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
