The petitioner seeks regular bail in connection with Khidi More P.S. Case No. 61 of 2019 registered under sections 25(1-b)a/26/35 Arms Act.
The allegation against the petitioner is that the police has recovered one loaded country made pistol from the waist of the petitioner and one another country made pistol and one live cartridge from the house of the petitioner.
Learned counsel appearing for the petitioner submits that the petitioner has falsely been implicated in this case. The house of the petitioner was raided by the police and seizure was not prepared as per provision of 100 Cr.P.C. Learned counsel further submits that no independent witnesses have signed the
Patna High Court CR. MISC. No.63441 of 2019(3) dt.26-11-2019 2/2 seizure list.
After having heard learned counsel for the parties and taking into consideration the fact that two pistols and one live cartridge have been recovered from the possession of the petitioners, let the petitioner be released on bail after completion of six months of custody upon furnishing bail bond of Rs. 20,000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Danapur in connection with Khidi More P.S. Case No. 61 of 2019.
