The petitioner seeks pre-arrest bail in connection with Jehanabad P.S. Case No. 109 of 2019 for the offence alleged under Section 302/34 of the Indian Penal Code. The accusation is of killing of daughter of the informant, Meghnath Yadav, by her husband and in-laws, due to non-fulfillment of demand of dowry by pressing the neck. The submission of the learned counsel for the petitioner is that petitioner, who is mother-in-law of the deceased, had gone before a day of occurrence to her maika to call her brother for partition, due quarrel in the family. Further, submission is that co-accused, Dharmendra Yadav and Jira Devi, cousin brother and son-in-law of the deceased has already been allowed the privilege of pre-arrest

Patna High Court CR. MISC. No.62307 of 2019(2) dt.15-10-2019 2/2 bail vide Cr. Misc. No. 43054 of 2019 on 12.07.2019. The petitioner, who is a lady, aged about 60 years, has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Jehanabad P.S. Case No. 109 of 2019 shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jehanabad, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
