Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner apprehends arrest in connection with Lakhnaur (RSOP) P.S. case No. 276 of 2022 registered for the offences under Sections 379, 411 and 34 of the Indian Penal Code and Section 56(i) & 56(2) of Bihar Mining Amended Act and Section 21 of Bihar Amended Mineral Act.

Learned counsel for the petitioner submit that the petitioner is innocent and has falsely been implicated in the instant case due to dirty village politics. Further submission is that the petitioner has already deposited the fine imposed on him by as contained in Memo no. 20 dated 07.01.2023 at Annexure P/2.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, the petitioner, above named is directed to be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of A.C.J.M.-1, Jhanjharpur, Madhubani in connection with Lakhnaur (RSOP) P.S. case No. 276 of 2022, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
