This is an appeal under Section 14(A)(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 against the refusal of prayer for anticipatory bail vide order dated 06.03.2018 passed in A.B.P. No.46 of 2018 by the learned Special Judge (SC/ST Act), Gaya, in connection with Barachatti (Mohanpur) Police Station Case No.259 of 2016 registered under Sections 341/323/448/427/354/504/506/34 of the Indian Penal Code and Section 3(x)(xi) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.
Considering the nature of allegation disclosed against the
Patna High Court CR. APP (SJ) No.1033 of 2018 dt.28-06-2018 P2/ appellants, prima facie offence under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, is made out against the appellants for the purpose of consideration of prayer for anticipatory bail. Hence, the prayer is bared under Section 18 of the SC/ST Act.
Accordingly, the appeal stands dismissed.
